Terms of Service

These Terms of Service (“Terms”) govern the use of hosting services provided by Volyx (“volyx“, “we”, “us”, “our”). By purchasing or using our services, you (“Client”, “User”, “you”) agree to these Terms. 1. Services We provide services including but not limited to: Shared Hosting VPS / Dedicated Servers Game Hosting Domain-related services (if applicable) Service specifications are defined on our website or order page at the time of purchase. 2. Eligibility You must: Be at least 18 years old Provide accurate and complete information Be legally capable of entering into a binding contract under Indian law 3. Account Responsibility You are responsible for maintaining the security of your account. Any activity performed under your account is considered your responsibility. We are not liable for losses caused by unauthorized access due to weak passwords or user negligence. 4. Acceptable Use Policy (AUP) You must not use our services for: Illegal activities under Indian law Hosting or distributing: Malware, viruses, trojans Phishing or scam content Child sexual abuse material Copyright-infringing content DDoS attacks or network abuse Cryptomining (unless explicitly allowed) Spamming or bulk unsolicited emails We reserve the right to suspend or terminate services without notice if violations are found. 5. Indian Law Compliance You agree to comply with: Information Technology Act, 2000 Applicable rules including IT (Intermediary Guidelines) Rules Any other applicable Indian laws We will cooperate with lawful requests from Indian authorities when required. 6. Payments & Billing All payments are prepaid unless stated otherwise. Prices are exclusive of GST unless specified. Failure to pay on time may result in suspension or termination. We are not responsible for delays caused by payment gateways. 7. Refund Policy Refunds are provided only if explicitly mentioned in the service plan. Setup fees, domain registrations, and licenses are non-refundable. Abuse-related suspensions are not eligible for refunds. 8. Service Availability We aim for high uptime but do not guarantee 100% availability. Scheduled maintenance may cause temporary downtime. We are not liable for downtime caused by: Third-party providers Network outages Force majeure events 9. Data & Backups You are responsible for maintaining your own backups. We may offer backups as a best-effort service, not a guarantee. We are not liable for data loss. 10. Suspension & Termination We may suspend or terminate services if: Terms are violated Payments are overdue Illegal activity is detected You may terminate your services at any time, subject to our refund policy. 11. Limitation of Liability To the maximum extent permitted by law: We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid for the service in the last billing cycle. 12. Indemnification You agree to indemnify and hold harmless Volyx against claims, damages, or legal expenses arising from your use of the services. 13. Modifications We may update these Terms at any time. Continued use of services after changes constitutes acceptance. 14. Governing Law & Jurisdiction These Terms are governed by the laws of India. Courts located in UP shall have exclusive jurisdiction.
